QSERIES TERMS & CONDITIONS 2024 -2026

1. Order Fulfillment: Q-Series endeavors to process and fulfill all orders in a timely manner. However, we reserve the right to delay or cancel any order due to inventory constraints, supply chain issues, or other circumstances beyond our control.

2. Returns and Exchanges: Q-Series offers a 30-day return policy on all purchases. Customers may return items for a full refund or exchange, provided the items are unworn, unwashed, and in their original condition with tags attached.

3. Shipping and Handling: Q-Series offers free standard shipping on certain orders within the continental United States and other shipping options are available as per service provider charges. Customers are responsible for any applicable duties or taxes on international orders.

4. Product Descriptions: Q-Series makes every effort to accurately represent our products, including materials, sizing, and available colors. However, we cannot guarantee that the digital images or descriptions will perfectly match the physical item received.

5. Intellectual Property: All Q-Series designs, logos, and brand elements are the exclusive property of Q-Series and are protected by intellectual property laws. Unauthorized use or reproduction is strictly prohibited.

6. Privacy and Data Protection: Q-Series is committed to protecting the privacy of our customers. We will not share or sell any personal information without the express consent of the customer, except as required by law.

7. Limitation of Liability: Q-Series shall not be liable for any indirect, special, incidental, or consequential damages arising from the use or inability to use our products or services.

Limitation of Liability:

Q-Series shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses, resulting from (i) your access to, use of, or inability to access or use the Q-Series products and services (ii) any conduct or content of any third party on the Q-Series platform, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties(iii) any content obtained from the Q-Series platform or (iv) unauthorized access, use or alteration of your account or transmissions.

In no event shall the aggregate liability of Q-Series, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, arising out of or relating to the use of or inability to use the Q-Series platform exceed the amounts actually paid by you to Q-Series for the products or services at issue in the prior 12 months, or $100, whichever is greater.

The limitations of this Limitation of Liability section shall apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence) or otherwise, and even if Q-Series has been informed of the possibility of any such damage, and even if a remedy set forth herein is found to have failed of its essential purpose. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

8. Governing Law: These terms and conditions are governed by the laws of Zimbabwe, and any disputes arising from the use of the Q-Series online store shall be resolved in the courts of Zimbabwe.
